MN Short Sales - Minneapolis Short Sales

About 18.9 million homes in the U.S. stood empty during the second quarter as surging foreclosures helped push ownership to the lowest level in a decade.

The number of vacant properties, including foreclosures, residences for sale and vacation homes, rose from 18.6 million in the year-earlier quarter, the U.S. Census Bureau said in a report today. The ownership rate, meaning households that own their own residence, was 66.9 percent, the lowest since 1999.

Lenders are accelerating foreclosures as borrowers fall behind in mortgage payments after the worst housing crash since the Great Depression. A record 269,962 U.S. homes were seized in the second quarter, according to RealtyTrac Inc. Foreclosures probably will top 1 million this year, the Irvine, California- based data company said in a July 15 report.

“There are a lot of people losing their homes and either moving in with family or renting places to live,” said Patrick Newport, an economist with IHS Global Insight in Lexington, Massachusetts. “Foreclosures are still going up.”

The share of homes empty and for sale, known as the vacancy rate, was 2.5 percent, matching the year-earlier period and down from 2.6 percent in the first quarter, the Census Bureau said. The homeownership rate fell from 67.1 percent in the first quarter, the third straight decline. The rate reached a record high of 69.2 percent in the second and fourth quarters of 2004.

Empty Homes

Foreclosures are included in a part of the Census Bureau report that also tracks vacant properties under renovation or tied up in legal proceedings. There were 3.7 million such empty homes in the second quarter, up from 3.5 million in the year earlier period, the report said.

Bank seizures could also be counted as vacant properties for sale or rent, or as owner-occupied homes if lenders haven’t yet evicted previous owners, the federal agency said. There were 2 million empty homes for sale in the second quarter, up from 1.9 million a year earlier.

A record 4.6 percent of U.S. mortgages were in foreclosure in the first three months of 2010, according to a May 19 report by the Mortgage Bankers Association. The combined share of foreclosures and home loan delinquencies was 14 percent, or about one in every seven U.S. mortgages.

Demand for homes has slumped since the April expiration of a government tax credit for buyers. The rate of new-home sales last month was the second-lowest on record, behind May, the Commerce Department reported yesterday. Sales of previously owned homes fell 5.1 percent in June, the National Association of Realtors said last week.

Sales Gain

The tax benefit, worth as much as $8,000, spurred a 4.9 percent rise in sales last year, the first increase since 2005, according to the Chicago-based National Association of Realtors.

U.S. home prices retreated 13 percent in 2009 to a median of $172,500, following a 9.5 percent drop in 2008, according to the Realtors’ association. This year, prices may rise 0.8 percent, the first gain since 2006, according to a forecast on the trade group’s Web site.

The U.S. median home price tumbled 29 percent to an eight- year low of $164,600 in February, according to the Realtors. The median had reached a record high of $230,300 in July 2006.

So you are in trouble with your mortgage and your lender is a credit union. That is both good news and bad news. Let’s start with the bad news.

  • If you default on your mortgage the credit union chances are they will sue you for it. Yep, that’s right, they will take you to court and get a judgment that can be used to garnish your wages and lien other assets. The judgment will be reported to the credit unions, mess up your ability to obtain future mortgages indefinitely and generally make your life difficult.
  • If the credit union forecloses via advertisement in MN they may have waived their right to obtain a deficiency judgment against the borrower

The Good News

  • It is usually easy to get a credit union to work with you on a short sale. Most credit unions will accept the proceeds from a short sale and work out a settlement agreement on the remaining debt. Depending on your financial circumstances this could range from agreeing to forgive the remaining debt to setting up a payment plan for a portion or all of the debt.
  • They are willing to talk to you. At a large lender it can be a a frustrating chore to find ANYONE who can knowledgeably talk to you about your options. At least at the credit union the phone number to a manager is not a closely guarded secret and they may even answer their phone.

That’s right! If you had a property under contract prior to the APril 30, 2010 deadline, you now have until September 30, 2010 to get the transaction closed. Anyone with half a brain saw this extension on the horizon. Lenders are overwhelmed with mortgage processing. Wells Fargo is particularly behind. I have at least five closings with Wells Fargo as the buyers lender. None of them have closed on time so far. Wells is running about 30 to 45 days behind.

If the back up at the lenders wasn’t enough of a problem, we also have the trouble associated with getting short sale approvals in a timely manner. Historically lenders are slow to process short sales. While they have gotten better over the last few years, their job performance is still poor at best. The September 30th deadline will help to hold many deals together where a foolish buyer is motivated solely by the tax credit.

Fannie Mae and Freddie Mac  are now allowing struggling homeowners with loans backed by the government-sponsored enterprises, or GSEs, to sell their properties through a Short Sale or deed-in-lieu of foreclosure if they can’t get a loan modification, officials announced this week. Of course, tehy have always allowed this. But going forward the process will be streamlined. This is good news considering that they own about 75% of all the mortgages in the nation.
GSE loans were excluded from the Treasury’s Home Affordable Foreclosure Alternatives (HAFA) program’s guidelines, which went into effect in April. HAFA, which streamlines the Short Sale process, was created to help both homeowners and banks avoid foreclosure.
To be eligible for HAFA, Fannie and Freddie loans must first qualify for and enroll in the Home Affordable Modification Program (HAMP). GSE loans are eligible for HAFA only after HAMP and other home-retention options have failed.

Freddie Mac and Fannie Mae servicers must comply with the new HAFA procedures by Aug. 1; the program expires Dec. 31, 2012.
Fannie Mae’s HAFA servicing guide stipulates that, “All servicers must implement Fannie Mae’s HAFA for all conventional mortgage loans that are held in Fannie Mae’s portfolio, that are part of an MBS [mortgage-backed securities] pool that has the special servicing option, or that are part of a shared-risk MBS pool for which Fannie Mae markets the acquired property.”
Freddie Mac’s HAFA servicing bulletin specifies, “First-lien mortgages owned, guaranteed, or securitized by Freddie Mac that were originated on or before January 1, 2009.”
The GSEs will pay financial incentives to both servicers and borrowers who make use of a short sale or a deed-in-lieu to avoid a foreclosure on a HAMP-eligible loan. Servicers will receive $2,200 for every HAFA short sale and $1,500 for every HAFA deed-in-lieu completed. Borrowers are entitled to an incentive payment of $3,000 to assist with relocation expenses.

So you got married and now you have a house that you need to unload. Too bad the house is worth less than you owe. So how are you going to unload the house without paying a ton of cash? The short answer is…SHORT SALE. The bad news is that the short sale is going to damage your credit and make getting a mortgage difficult for the next year or two. The good news is that since the loans are only in your name (hopefully you did not add your spouse) the credit hit is NOT going to impact your new spouse.  If you and your new spouse are intending to purchase a new primary residence in teh near future, you may want to consider having your spouse purchase the home in their name only.

The good news is that by selling the house NOW via a short sale you will also not be responsible for insuring and maintaining it for the year (or years) it may take your lenders to foreclose on the property. A short sale allows you to cleanly and (relatively) quickly settle the debt and move on with the rest of your life.

If credit scores and ability to finance purchases for the next several years is not a concern, then you may want to consider allowing the property to go to foreclosure.  You could choose to either reside in the property or rent it out. If you decide to rent it out, be aware that you open yourself up to a lot of liability. I would strongly recommend that you hire a COMPETENT property management company who can successfully lease your property, manage teh tenants and provide all legally required disclosures to tenants throughout the process.  I am aware of one excellent property management company in the Twin Cities area that I would refer you to. As real estate agents all over the country have been holding their breath to see if the offers they accepted by April 30th will actually CLOSE by june 30th. Given that banks are WAY behind on processing buyer loans that need to close by June 30th and short sales always have uncertain timing, congress is considering giving buyers until September 30, 2010 to close.

As a MN short sale real estate listing agent, I have to agree that the extension for closing is a good idea. A surprising number of buyers are solely motivated by this tax credit (which is a silly reason to purchase real estate).

GE Financial just released a mortgage product in the UK that is a zero down mortgage that allows a borrower to have up to two loan defaults (including mortgages) and one judgment. The UK was hit just as hard by the housing crisis as the United States was. I predict that sub prime loans will be available again in the USA within the next three years. If lenders never learn, why should consumers?
